ICC: Duterte probe unaffected by disqualification of chief prosecutor

The International Criminal Court (ICC) assured last week that its investigation into former president Rodrigo Duterte’s alleged crimes against humanity remains unaffected by the disqualification of Chief Prosecutor Karim Khan.

“This disqualification has no impact on the ongoing case against Mr. Duterte,” ICC Spokesperson Fadi el Abdallah said, adding that the probe is now being led by Deputy Prosecutor Mame Mandiaye Niang.

A court document dated October 15 confirmed Khan’s disqualification by the ICC Appeals Chamber due to his prior involvement—before assuming office—in the submission of information related to Duterte’s alleged offenses in the Philippines. 

While the chamber found no proof of actual bias, it said certain factors created an “appearance of bias” that could affect the prosecutor’s impartiality.

Despite this, the ICC Office of the Prosecutor reaffirmed that its independent and impartial investigation into the situation in the Philippines is ongoing. 

A multidisciplinary team under Niang continues to lead the probe, gathering evidence from witnesses, states, international partners, civil society groups, and public sources.

“The victims and survivors in the Philippines situation deserve justice and accountability,” the Office said. “Our work will continue to ensure justice is pursued impartially and independently.”
