Senator Imee Marcos’ pointed question during a Senate hearing—whether authorities possessed a copy of the International Criminal Court (ICC) warrant of arrest at the time of former President Rodrigo Duterte’s supposed apprehension—raises crucial legal and procedural concerns. 

Her inquiry underscores the need for transparency in the country’s stance on the ICC and the rule of law.

The ICC’s jurisdiction over Duterte has been a contentious issue. The Philippines, under his administration, withdrew from the ICC in 2019, rejecting its authority over alleged crimes committed during his tenure. 

However, international legal principles maintain that withdrawal does not absolve responsibility for offenses committed while a country was still a member. 

This legal limbo has fueled debate over whether the ICC can validly pursue Duterte and, more importantly, how Philippine law enforcement should respond.

Senator Marcos’ question puts into sharp focus the government’s preparedness and understanding of international legal obligations. 

If no official copy of an ICC warrant was in the hands of Philippine authorities at the time, was there a legitimate basis for any supposed arrest? 

The lack of clarity only adds to growing public confusion and fuels suspicions of political maneuvering.

Beyond the legal technicalities, the bigger issue at stake is the Philippines’ commitment to justice—both domestic and international. 

The government must articulate a firm position: Will it cooperate with the ICC or assert its sovereignty to the exclusion of external legal bodies? 

Failure to provide a clear stance risks further eroding public trust in the justice system and could cast the country in a negative light on the world stage.

In a democracy, the rule of law must be upheld with consistency, not selectively invoked when convenient. 

Senator Marcos’ inquiry should not be dismissed as mere political posturing but rather taken as an opportunity for authorities to establish transparency in handling such high-stakes legal matters. 

The nation deserves answers, and more importantly, legal clarity.
